I. What
is Entertainment Law?
Entertainment Law (sometimes referred to as media
law or sports law) is a specialized area of the law that caters to clients
involved in the business of providing entertainment to the public. Entertainment Law is comprised of a mix of
more traditional categories of law with a focus on providing legal services to
the entertainment industry.
Entertainment Law overlaps with intellectual property law (especially
trademarks and copyright), employment & labor law, corporate law,
alternative dispute resolution (ADR), real estate, criminal law, estate
planning & administration, international law, litigation, matrimonial law,
taxation, immigration, and agency law.
Entertainment Law can be divided into two broad
categories: (1) “transaction-based,” which involves drafting and
negotiating entertainment contracts; and (2) “litigation-based,” which involves
resolving entertainment disputes through either filing a lawsuit or mediation
or arbitration.
Although entertainment industries share many legal
concepts, each has its own culture, customs, trade unions (in some cases),
rules, case law, negotiation strategies, and practices. Thus, Entertainment Law can be further
sub-divided into the following areas related to the types of entertainment
activities involved:
